Islamabad High Court dismissed the petition against the appointment of Nisar Durrani


The Islamabad High Court dismissed the petition against the appointment of Nisar Durrani, a member of the Election Commission from Sindh.

Chief Justice Athar Manullah dismissed the petition after the lawyers' arguments.


During the hearing, Fawad Chaudhry's lawyer Faisal Chaudhry said that the appointment of Nisar Durrani was a violation of Article 216.


The Chief Justice of the Islamabad High Court questioned that this is a constitutional appointment, how can a member be removed? This court has to decide on the constitution.


Giving remarks, the Chief Justice said that he would not interfere with any matter, would not interfere with the constitutional position dispute.


Chief Justice Athar Manullah said that you should read the clause of the constitution again, it is very clear, that this appointment happened after fulfilling the constitutional requirements, so can be removed.


He said that Fawad Chaudhry's party was also involved in the appointment. The court must implement the constitution. At that time, the parliamentary committee had appointed it.


It may be recalled that Pakistan Tehreek -e -Insaf (PTI) leader Fawad Chaudhry had filed a petition against the appointment of Nisar Darani.


Fawad Chaudhry has requested the deployment of Nisar Durrani unconstitutional in a petition filed by the Islamabad High Court.


The petitioner is of the view that Nisar Durrani is performing the duties of the Sindh government as principal at La College.


The petition has requested that Nisar Durrani Member is not eligible to remain the Election Commission, the court should declare the appointment unconstitutional.
